Product Warranty Policy

This document sets out UPRYTE's express product warranty for all chair collections. It is supplementary to  and does not limit or exclude  your statutory rights under the Australian Consumer Law (ACL). Where this warranty provides greater protection than the ACL, the warranty terms apply. Where the ACL provides greater protection, the ACL prevails.

Version 1.0  Effective from launch date. Governed by the laws of Victoria, Australia.

1. Warranty Registration

To activate UPRYTE's express warranty which provides coverage above and beyond your minimum rights under Australian Consumer Law you must register your product within 30 days of delivery.

You will need your order number and delivery date. Upon registration, UPRYTE will issue a warranty confirmation to your registered email address.

Important: Warranty registration does not affect your rights under Australian Consumer Law. Unregistered products retain full ACL consumer guarantee protections. Registration is required only to access UPRYTE's extended express warranty terms above the ACL minimum.

2. Warranty Coverage Periods

The express warranty period begins on the date of delivery to the original purchaser. Use beyond the maximum weight capacity listed below voids the warranty for all components.

3. What Is Covered

During the applicable warranty period, UPRYTE warrants that your chair will be free from defects in materials and workmanship.

3.1 Frame & Structural Components

  • Cracking, fracturing, or structural deformation of the chair frame, base, or backrest support under normal use
  • Weld failures or joint separations in the chair frame
  • Failure of the aluminium or nylon base under normal operating loads within the stated weight capacity

3.2 Mechanisms

  • Failure of the tilt or recline mechanism to lock, release, or function as designed
  • Height adjustment failure where the chair sinks unexpectedly or cannot be adjusted
  • Armrest adjustment mechanisms that seize, break, or fail to hold position
  • Seat slider failure where present

3.3 Mesh & Upholstery Structural Failure Only

The mesh warranty covers structural failure of the mesh fabric specifically: tearing, splitting at seams, fraying from attachment points, or detachment from the chair frame.

The mesh warranty does not cover gradual softening or reduced tension through normal daily use, minor texture changes or surface wear, or colour variation from light exposure over time. These are expected characteristics of mesh upholstery and are not defects.

3.4 Gas Cylinder

  • Unexpected chair sinking or height instability caused by cylinder failure
  • Cylinder that cannot be adjusted or locks in position due to a manufacturing defect

3.5 Castors

  • Castor wheels that crack, seize, or detach under normal floor use
  • Structural failure of the castor socket

4. What Is Not Covered

The following are expressly excluded from UPRYTE's warranty. Your ACL rights are not affected by these exclusions.

  • Normal wear and tear, including gradual softening of mesh or foam, surface abrasion, minor scuffs, or colour fading through regular use
  • Damage caused by use beyond the maximum weight capacity stated in Section 2
  • Damage caused by misuse, abuse, accidental impact, or deliberate damage
  • Cosmetic damage (scratches, dents, surface marks) that does not affect structural integrity or function
  • Damage resulting from incorrect assembly where UPRYTE's assembly instructions were not followed
  • Damage caused by unauthorised modifications, repairs, or alterations
  • Damage from exposure to liquids, extreme heat, outdoor environments, direct prolonged sunlight, or high-humidity environments
  • Damage caused by improper cleaning products including bleach, solvents, or abrasive chemicals
  • Transit damage where delivery was accepted without a damage claim raised within 48 hours of receipt
  • Products purchased from unauthorised third-party sellers or resellers not approved by UPRYTE in writing
  • Failure arising from multi-shift use (more than 8 hours per day) or use by more than one person per day without commercial warranty terms agreed in writing
  • Acts of God including fire, flood, storm, earthquake, and other natural events

5. Ownership and Transferability

This warranty is personal to the original purchaser only. It is non-transferable and becomes void upon resale or transfer of the chair to another party. UPRYTE may request proof of original purchase including the original order confirmation email and delivery address to verify warranty eligibility.

6. Domestic and Commercial Use

The UPRYTE express warranty covers single-shift use of up to 8 hours per day by a single user in a domestic home office or standard single-shift commercial office environment.

The warranty does not cover chairs used in multi-shift environments, 24-hour facilities, shared-access offices, co-working spaces, or environments with rotational staff. Business customers requiring multi-shift commercial coverage should contact UPRYTE at warranty@upryte.com.au before purchase.

Note: Your rights under Australian Consumer Law apply regardless of whether the chair is used domestically or commercially, where the chair was purchased for personal use.

7. How to Make a Warranty Claim

Claims should be submitted as soon as a defect is discovered, within the applicable warranty period. Your rights under Australian Consumer Law are not subject to any notification timeframe under this policy.

Email warranty@upryte.com.au with your order number, a description of the defect, and clear photos or video of the issue.

UPRYTE will assess your claim within 3 business days. We may request that the defective component or chair be returned for physical inspection. Where the claim is approved, UPRYTE covers all return freight costs.

Once approved, UPRYTE will determine the remedy repair, replacement part, or full chair replacement. For major failures as defined under Australian Consumer Law, you may choose between a replacement or full refund.

Please retain your original order confirmation email as proof of purchase. UPRYTE may also request photos, video, serial numbers, or physical inspection of the defective component before approving a claim.

8. Warranty Remedy

8.1 Minor Failures

Where a warranty claim is accepted and the failure is minor, UPRYTE will determine the appropriate remedy at UPRYTE's discretion:

  • Repair of the defective component
  • Supply of a replacement part with installation instructions (see Section 9)
  • Replacement of the chair with the same or comparable model (see Section 10)

UPRYTE's remedy obligation for any given defect is fulfilled upon completion of the first approved repair or replacement. The warranty does not provide for unlimited replacement of the same component.

8.2 Major Failures

Where a defect constitutes a major failure under Australian Consumer Law a defect so significant that a reasonable consumer would not have purchased the chair had they known, or a defect that renders the chair substantially unfit for its purpose or creates an unsafe condition you are entitled, at your choice, to:

  • A full replacement of the chair with the same or comparable model; or
  • A full refund of the original purchase price

You may also be entitled to compensation for other losses reasonably foreseeable as a result of the failure, as provided by the Australian Consumer Law.

9. Self-Installation of Replacement Parts

Where UPRYTE determines that a replacement part can be installed by the customer without professional assistance, UPRYTE will provide the part together with clear installation instructions. Damage arising from incorrect self-installation is not covered under warranty. If you are not comfortable with self-installation, contact UPRYTE to discuss alternative arrangements.

10. Replacement Models

Where a full chair replacement is the approved remedy and the original model is still available, UPRYTE will replace it with the same model in the same colour or the closest available variant.

Where the original model has been discontinued, UPRYTE will provide a replacement with a current model of equivalent or greater retail value at the time of replacement, at UPRYTE's discretion.

A replacement does not reset, extend, or create a new warranty period the original warranty period continues from the original delivery date.

11. Spare Parts Availability After Warranty

UPRYTE will use reasonable commercial efforts to maintain availability of replacement parts for a minimum of 5 years beyond the end of the express warranty period for each model currently sold. Availability is subject to supplier continuity and product viability.

Spare parts may be purchased after the warranty period at the prevailing retail rate. Contact warranty@upryte.com.au to enquire about availability and pricing.

12. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, UPRYTE's liability under this express warranty is limited to the repair, replacement, or refund of the defective product as described in Section 8.

UPRYTE is not liable for any indirect, incidental, special, or consequential loss or damage including lost income, property damage to unrelated items, or business interruption arising from a product defect, except as required by the Australian Consumer Law.

Nothing in this section limits liability for personal injury caused by a defective product. See Section 13.

13. Personal Injury and Product Safety

This warranty does not govern claims for personal injury. If you believe a product defect has caused or poses a risk of personal injury, contact UPRYTE immediately at warranty@upryte.com.au so we can investigate urgently and, where necessary, notify the relevant regulatory authority.

Product liability for personal injury is governed by Australian Consumer Law and applicable tort law, and is not limited by this warranty document.

14. Your Statutory Rights Under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in this warranty policy excludes, restricts, or modifies your consumer rights or remedies under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or under any other applicable state or territory law that cannot be excluded by contract.

UPRYTE does not display 'no refund' or similar policy language that misrepresents your ACL rights. If you believe your consumer guarantee rights have not been respected, you may contact the ACCC or your state consumer affairs agency.

15. Governing Law and Dispute Resolution

This warranty is governed by the laws of the State of Victoria, Australia, and the applicable laws of the Commonwealth of Australia.

If a warranty dispute cannot be resolved directly with UPRYTE, you may escalate to:

  • Consumer Affairs Victoria (CAV)
  • Victorian Civil and Administrative Tribunal (VCAT)
  • Australian Competition and Consumer Commission (ACCC) for systemic concerns

UPRYTE will cooperate fully with any tribunal or regulatory authority in respect of a consumer warranty dispute.
